The mitigation <br /> site,known as Geisart Pit,is located in Section 31,Township 6 North,Range 66 West,Weld <br /> County,Colorado,and was to compensate for the loss of 2.4 acres of wetlands associated with <br /> sand/gravel mining activities that occurred at the 83`d Avenue Gravel Pit. <br /> Pursuant to recent negotiations,the following special conditions supersede corresponding; <br /> existing conditions of permit number 199980251: <br /> E. The permittee agrees to place 6.59 acres of project site(see attached survey)into a deed <br /> restriction and guarantees that—at any time in the future—a minimum of 3.6 acres of <br /> vegetated wetlands will be maintained on the site in perpetuity. <br /> F. The permittee agrees that during all years that mining occurs in the adjacent pits,he will: <br /> 1. follow the hydrology augmentation plan outlined in a submittal dated June 29,2005 <br /> (partial copy attached) <br /> 2. establish a prominent mark on the outlet structure of the adjacent mine pit to indicate <br /> the minimum water surface required to maintain the hydrology in the wetlands <br /> 3. monitor the wetlands as outlined in the original permit and include permanent photo <br /> stations submitting a monitoring report by December 3 1" of any year in which <br /> mining occurs <br /> G. The permittee agrees to submit monitoring reports for two consecutive years following any <br /> year in which the mitigation site fails to have a minimum of 3.6 acres of wetlands. <br /> H. The DA agrees to acknowledge and respond to any issues presented in the cover letter to <br /> monitoring report within 90 days. <br /> I. The permittee agrees that if the mitigation area does not meet the required amount of <br /> wetlands in any two consecutive years,the DA can unilaterally modify the permit to require <br /> full completion of mitigation through the purchase of credits at a mitigation bank. <br /> These Special Conditions are drawn from a letter the DA sent you documenting agreements <br /> you made during the site visit of September 1,2005. Therefore,your permit number 199980251 is <br /> hereby amended by adding the above Special Conditions to the document.
