Retained Jurisdiction. If any person wishes to object to the addition of a <br /> water right under paragraph 16, that person shall file a written objection with <br /> the Court within thirty-five(35) days of receipt of the Notice of Use of Water <br /> Right for Augmentation. The court retains jurisdiction to resolve such <br /> objection and the Applicant shall have the initial burden of proof to show that <br /> use of the proposed source is sufficient to prevent injury to vested water <br /> rights and decreed conditional rights. If no objection is filed, then Weld <br /> County may use the noticed water right in this plan in the manner stated in <br /> the Notice without further action by the Court. If an objection is so filed, <br /> then Applicant may not use the noticed water rights until the Court <br /> determines whether, and under what terms and conditions necessary to <br /> prevent injury to vested water rights and decreed conditional rights, the <br /> noticed water rights may be used in this plan. <br /> 17. Transit Losses. When any water used as an augmentation supply in this plan is transported in <br /> the Cache la Poudre River or its tributaries to the required location of augmentation <br /> deliveries under this Decree, the Division Engineer shall assess transit losses from the point <br /> of introduction to the stream to the point of replacement in the same manner as for other <br /> water users using the same reaches of the stream for carriage. <br /> 18. Accounting: Weld County will install such measuring devices as are reasonably determined <br /> by the Division Engineer to be necessary for the proper administration of this Decree. <br /> Accounting for this plan shall be done daily and maintained and reported on a monthly <br /> accounting form reasonably acceptable to the Water Commissioner and Division Engineer. <br /> The accounting form, Exhibit B attached hereto, contains the information necessary to <br /> account for this augmentation plan; however, it is not specifically decreed herein and may be <br /> modified as agreed upon by Applicant and the Division Engineer provided it remains <br /> consistent with this Decree. This accounting form may be integrated with Applicant's other <br /> accounting forms. The accounting form for this plan for augmentation shall, at a minimum, <br /> include the following information: name, priority and administration number of the calling <br /> water right, monthly evaporative losses, lagged stream depletions, amount released from <br /> Geisert Reservoir for augmentation, leased amount of Greeley's effluent, and the net impact <br /> on river(-depletions 4-accretions). If otherwise consistent with the provisions of this Decree, <br /> Exhibit B may be modified from time to time at the request of or as approved by the Division <br /> Engineer and with notice to all Objectors in this case, provided that all information contained <br /> in Exhibit B and required by this Decree is included. Applicants shall serve notice to <br /> Objectors when any changes to Exhibit B are submitted to the Division Engineer. Objectors <br /> shall have 63 days from the notice of changes to the accounting form to provide comments to <br /> the Division Engineer regarding such proposed changes. The accounting for this Decree <br /> shall be submitted to the Division Engineer on a monthly basis and made available to any <br /> objector in this case upon reasonable request and reimbursement of expenses related to <br /> production of the same except that if the accounting is provided to the Division Engineer in <br /> an electronic format, it shall be provided in the same format to requesting objectors at no <br /> charge. Weld County shall be responsible for submitting all necessary information to the <br />
