Wetland Delineation Report for the Global Assets Mine Property, Weld County, Colorado <br /> downstream waters of the U.S. (i.e.,the South Platte River),the USACE may consider this ditch <br /> to support jurisdictional waters, thereby subjecting it to the permitting authority of Section <br /> 404 of the Clean Water Act (USACE 2007). <br /> Ditch 02,would likely not be considered jurisdictional as its connection to downstream waters <br /> appears non-existent. <br /> The USACE reserves the right to evaluate the jurisdictional status of ditches on a case-by-case <br /> basis and any determination of jurisdictional status of ditches is only valid if performed by <br /> USACE staff. <br /> 4.5 Protected Species <br /> 4.5.1 Weld County Threatened and Endangered Species <br /> Determination of the listed species that are evaluated in this report was based on the list of <br /> federally listed species for Weld County, Colorado, provided in an IPaC Trust Resources Report <br /> (USFWS 2016). In total, nine species are listed for the project area (Table 1). <br /> Table 2. An additional five species, whooping crane (Grus <br /> americana), piping plover(Charadrius melodus), least tern (Sterna antillarum),western prairie <br /> fringed orchid (Platanthera praeclara),and pallid sturgeon (Scaphirhynchus albus),collectively <br /> referred to as "Platte River Species", are listed for Weld County due to concerns over water <br /> depletions that may impact downstream populations and critical habitat within the Platte <br /> River drainage. The South Platte River, which adjoins the eastern edge of the Project Area, is <br /> tributary to the Platte River; however, no effects or depletions of the Platte River or its <br /> tributaries are proposed as part of this project.
