The purpose of this inspection was to evaluate the on-the-ground <br />condition with respect to the Bowie No. 2 Mine’s Phase I, II, and III bond release application, SL-02 in <br />accordance with Rule 3.03.2(2). Bill Bear of Bowie Resources; Howard Strand of the Office of surface Mining, <br />Reclamation, and Enforcement; Desty Dyer of the Bureau of Land Management and Jim Stover of J. E. Stover and <br />Associates accompanied the inspection. The weather was clear and the ground was dry during the inspection on <br />November 1 and the ground was wet the morning of November 2. All areas to be inspected were accessible and <br />visible. <br /> <br />Lands requested for liability release based on the SL-02 application included 33 sealed drillhole sites and <br />associated roads totaling portions of 24.2 acres of Phase I reclaimed through 2016. Surface land ownership is <br />private and Federal and mineral ownership is private and Federal. During the inspection, 11.9 acres of Phase I gob <br />pile area was removed removed from the SL-2 request based on a future request ot include areas currently being <br />covered with material and topsoil. All sites visited are noted in the text and table below. Sites that were requested <br />for bond release, but not visited are also noted. <br /> <br />Examples of sites and conditions are in the photographs below. <br /> <br />BACKFILL and GRADING – Rule 4.14 Contemporaneous Reclamation 4.14.1; Approximate Original Contour <br />4.14.2; Highwall Elimination 4.14.1(2)(f); Steep Slopes 4.14.2, 4.27; Handling of Acid and Toxic Materials <br />4.14.3; Stabilization of Rills and Gullies 4.14.6: <br /> <br />Per Rule, up to sixty percent of the applicable bond amount shall be released when the permittee successfully <br />completes backfilling, regrading, and drainage control in accordance with the approved reclamation plan. With <br />regard to this SL-02 Phase I bond release, BRL applied for a partial Phase I bond release of 24.2 acres of disturbed <br />lands associated with the backfilled and graded area at portions of Gob Pile #2 and Gob Pile #1 totaling 11.9 acres. <br />Thirty-three drill sites and associated spur roads representing 12.3 acres were initially requested for Phase I with <br />SL-02. <br /> <br />Of the Phase I requested sites visited, the sites were stable with no evidence of erosion or instability during the
