PERMIT#: M-2010-071 <br /> INSPECTOR'S INITIALS:MAC <br /> INSPECTION DATE: October 7,2016 <br /> OBSERVATIONS <br /> The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br /> (Division). Jon File with Rock Products, Inc., the company contracted to construct the reservoir, was present <br /> for the inspection. No representative from the City of Lafayette attended the inspection. The Goose Haven <br /> Reservoir#2 mine is located two miles north of the City of Lafayette on the west side of U.S. Highway 287. <br /> The commodities of interest are sand and gravel.The operation is permitted for 232 acres and the post-mining <br /> land use is developed water resource. <br /> The purpose of this inspection was to follow up on the previous inspection conducted on July 30, 2015. During <br /> the 2015 inspection, the Division found the Operator had deviated from the approved Mining Plan. <br /> Specifically, the Operator had changed the method of lining the reservoir from slurry wall to clay liner. In <br /> addition, the Operator created a second reservoir in the processing area which was not a part of the approved <br /> Mining Plan. The Division cited a problem for failure to follow the approved Mining Plan and required the <br /> Operator to submit an Amendment Application by August 7, 2015. The Operator submitted an incomplete <br /> Amendment Application to the Division on August 5, 2015. The Amendment Application was filed for review <br /> on August 24, 2015. The Division mailed the first Adequacy Letter for the Amendment Application on October <br /> 10, 2015.To date, the Division has not received a response to the October 10, 2015 Letter. <br /> The initial review time frame for an Amendment Application is 90 days from the date the application is filed <br /> for review. Pursuant to Rule 1.4.1(9), the Operator may request an extension of the decision date, not to <br /> exceed 365 days from the date the application was filed. At the request of the City of Lafayette, the decision <br /> date was extended out to 365 days from the filing date. The Division will grant one final extension of the <br /> corrective action date. If the Amendment Application is not in an approvable form by the new decision date, <br /> then the application will be denied. In addition, the Division will set the matter before the Mined Land <br /> Reclamation Board for consideration of a possible violation for failure to follow the approved Mining Plan. <br /> Notice of the extension of the decision date for the Amendment Application will be sent under separate cover. <br /> The site conditions at the Goose Haven Reservoir are mostly the same as they were during the 2015 <br /> inspection. The Operator has removed the majority of the overburden from the processing area which was <br /> situated within the 100 year flood plain of Bullhead Gulch. Mining within the southern cell is nearing <br /> completion.The Operator is removing the remaining product stockpiles and dressing the pit slopes. The <br /> Operator notified the Division that construction of the keyway for the clay liner would occur in the next <br /> several months. The Division informed the Operator that no portion of the clay liner may be constructed until <br /> such time as the Amendment Application is approved.
