COLORADO <br /> Division of Reclamation, <br /> Mining and Safety <br /> Department of Natural Resources <br /> 1313 Sherman Street,Room 215 <br /> Denver,Colorado 80203 <br /> October 28, 2016 <br /> Greg Westoff <br /> Morgan Sand and Gravel <br /> PO Box 1443 <br /> Ft Morgan CO 80701 <br /> Re: Westoff Pit, Permit #M1977-094, Receipt of Incomplete 112 Construction Materials Permit <br /> Amendment Application Package <br /> Mr. Westoff, <br /> On October 18,2016,the Division of Reclamation,Mining and Safety received your 112 Construction <br /> Materials Reclamation Permit Amendment Application package(AMO1)for the Westoff Pit(M-1977-094). <br /> The submittal of AMO1 was a required as part of a Mined Land Reclamation Board(MLRB)corrective <br /> action. This corrective action required the submittal of a complete amendment application by October 4, <br /> 2016(90 days from the date of the board order). Because the AMOI submittal is currently incomplete and <br /> past due,the matter is currently set for the November 16,2016 MLRB hearing for enforcement for failure to <br /> comply with a Board Order as outlined in the RTB letter dated October 13,2016. You may wish to request <br /> a modification to the existing MLRB order to extend the corrective action deadline in order to address <br /> the deficiencies in the current submittal. For example,if the MLRB were to approve a 60 day extension, <br /> the new corrective action deadline would be December 3,2016. <br /> Preliminary review of the information received determined that the following items must be received before <br /> the Division can consider,your application as being complete/submitted and technical review can begin: <br /> APPLICATION FORM: Items 5.2,6,and 7 on the application form need to be completed,and pages 5-8 <br /> of the application form were missing. <br /> EXECUTED PERFORMANCE WARRANTY: Please execute a new performance warranty for the <br /> permit as required by Rule 4.1.1. This form may be obtained from the DRMS website at <br /> mining.state.co.us/SiteCollectionDocuments/PerformanceWarranty.pdf <br /> EXHIBIT B-Index Map(Rule 6.4.2): An index map showing the regional location of the affected land <br /> and all roads and other access to the area. A standard U.S. Geological Survey topographic quadrangle or <br /> equivalent is acceptable.
