The map was submitted on October 19, 2016. The map depicts two area
where previous rills and gullies have been observed. One area is located in the SIIPM-6 drainage west of
stock tank T-32 in non -Phase III release areas. Another rill and gully is noted in the reclaimed solid waste
disposal area. In accordance with Rule 4.14.6, rills and gullies which form in areas that have been
regraded and topsoiled shall be filled, regraded, or otherwise stabilized when such rills and gullies: (1)
disrupt the approved postmining land use; (2) prohibit successful revegetation; or (3) cause or contribute
to a violation of water quality standards for a receiving stream. If any of the identified rills and gullies
meets the criteria set forth in Rule 4.14.6, please take the necessary corrective action. Please keep in
mind that effort should be made to limit the extent of rill and gully stabilization efforts in order to not re-
initiate the 10 -year liability period in accordance with Rule 4.15.7(5)(a).
The map also depicts several areas where maintenance has been required. These areas include the smart
ditches above the portal area (FA -D5 and FA -D6), the slump above the portal, the repairs to the Pond 004
outlet, culvert SC -27 and a weed control area above the lower sump. Peabody Sage Creek Mining should
continue to monitor these areas and conduct any of the required maintenance. The Division will also
monitor these area during regular monthly inspections.
If you have any questions feel free to contact me at (303) 866-3567, extension 8120.
Sincerely,
P6)_at_
Jared Ebert
Environmental Protection Specialist III
1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http://mining. state. co. us
John W.
