The Construction Materials
Rules 3.1.9(6)and 3.1.5(9)are pertinent to your importing topsoil question. Specifically,the Operator would
need to provide the Division with a notice of intent to import material. The notice should include:
i. a narrative that describes the approximate location of the proposed activity;
ii. the approximate volume of inert material to be backfilled;
iii. a signed affidavit certifying that the material is clean and inert, as defined in Rule 1.1(20);
iv. the approximate dates the proposed activity will commence and end,however, such dates shall
not be an enforceable condition;
v. an explanation of how the imported material will result in a post-mining configuration that is
compatible with the approved post-mining land use; and
vi. a general engineering plan stating how the material will be placed and stabilized in a manner to
avoid unacceptable settling and voids.
I have included an example affidavit for your reference.
I hope this helps answer your questions. If you have any questions or need further information,please contact
Amy Echberger at(303)866-356 8129.
i
Sincerely,-_----'
-='
j ,i
TC Wait
Environmental Protection Specialist
cc: WAE, DRMS
AME, DRMS
File
OF COCO
1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http://mining.state.co.us I  =_'  90
John W.
