Mr. Brock Bowles -2- October 20, 2016 <br />2.05.5 — Postminina Land Uses — Underground Mininq Activities <br />1. DRMS: Please provide a discussion of the relationship of the proposed commercial/industrial <br />land use to existing Mesa County and U.S. BLM (e.g. Coal Canyon access road) land use <br />policies and plans. Rule 2.05.5(2)(a). <br />SCC: Response addressed in letter dated September 1, 2016. <br />2. DRMS: Please describe how the proposed commercial/industrial land use is to be achieved <br />and the necessary support activities needed to achieve the proposed commercial/industrial land <br />use. Rule 2.05.5(2)(a)(i). <br />SCC: Permit page 15-2 has been revised addressing activities needed to achieve the proposed <br />commercial land use change. <br />4.16.3 — Alternate Land Uses <br />1. DRMS: Letters stating that Mesa County and Town of Palisade `support' the Sports Complex <br />were included in the application. These letters did not indicate that the Sports Complex was <br />approved. Rule 4.16.3(1) states that "any required approval, including any necessary zoning or <br />other changes required for land by local, State or Federal land management agencies, shall be <br />obtained..." Please clarify in the text if any required approvals for the Sports Complex have been <br />obtained. <br />SCC: A copy of the Conditional Use Permit (CUP), approved by the Board of Mesa County <br />Commissioners, is attached as Appendix pages A15-3-9 through A15-3-22. <br />3.03.1 — Criteria and Schedule for Release of Performance Bonds <br />1. DRMS: Commercial/Industrial is the alternate postmining land use for the North Portal area. <br />Rule 3.03.1(3)(e) states that when commercial/industrial is the alternate postmining land use, the <br />Division shall require the maintenance of bond coverage sufficient to achieve the standards of <br />revegetation applicable to the pre -mining land use in the event the alternate land use is not <br />developed. Please amend the text in the postmining land use section stating that the alternate <br />postmining land use is commercial/industrial and in the event that the alternate is not developed, <br />the success standard for the purposes of bond release will revert back to that of fish and wildlife. <br />SCC: Response addressed in letter dated September 1, 2016. <br />ADDITIONAL CHANGES TO PERMIT REVISION #6 <br />SCC has revised the number of acres that were initially requested to be changed from fish and <br />wildlife to commercial postmining land use. The 1.2 acres associated with Pond 11 have been <br />added, making the total acres requested for change in postmining land use to 4.0 acres. There <br />are 2.2 acres at the CRDA #1, 0.6 acres associated with G Substation and 1.2 acres at reclaimed <br />Pond 11. Permit pages 14-11 i and 15-2 along with Exhibit 63 have been revised to reflect this <br />change. <br />Enclosed are the following new or revised pages/exhibits: <br />Volume 1, Tab 3: Revised Tables 3-1 and 3-6 <br />Revised Exhibit 3 <br />
