a backhoe excavation to the east of the residual Oldcastle Ewing Mesa #1 overburden <br />pile. If this is the feature of interest, I cannot provide any history as to when or who <br />excavated this feature. It was not a part of the collection ditch that directed surface <br />runoff from the equipment area to sediment pond # 1. <br />Item 3: Musk thistle seen around the site, including reclaimed sediment pond #2 <br />Oakridge Energy conducts spraying for noxious weeds each year within the boundaries of <br />the coal permit area. Of the areas we canvassed during the inspection, the only area <br />where the presence of thistle would warrant more attention was sediment pond #2 in my <br />professional opinion. Other occurrences of thistle appeared to be scattered individuals, <br />not infestations, and appeared to have fewer individuals that adjacent native areas. <br />Oakridge proposes to consult with Mr. Katz, and defer to his desires, as he has an overall <br />weed management plan for the property. <br />Item 4: Erosion on the Boundary Road <br />As discussed previously with the Division, the areas of significant erosion on the <br />Boundary Road are outside the Carbon Junction Mine permit boundary. The reclamation <br />and maintenance of the Boundary Road, with the exception of the short segment <br />immediately adjacent to the PRSA, was the responsibility of Four Corners Materials. <br />The Division released Four Corners Materials reclamation bond in 2015. <br />Item S: Damage by trespassers on Topsoil Stockpile #2 <br />Oakridge would like further clarification on this comment. The evidence of trespassers <br />observed appeared to be tire tracks that did not appear to significantly impact the <br />reclamation. Do you have further information or photos that show significant damage to <br />the reclaimed topsoil pile? Ms. Compton discussed the history of adjacent landowner <br />trespass with Oakridge, and Oakridge understood that Mr. Katz would be addressing the <br />issue in the future. <br />Oakridge is consulting with Mr. Katz and Ms. Compton regarding any remedial activities <br />to address the above areas.
