Brubaker <br />VALCO, INC. <br />9296 Windhaven Dr. <br />Parker, CO 80134 <br /> <br /> <br />Re: Canon City East Pit, Permit No. M-1977-559, Technical Revision Approval, Revision No. TR-4 <br /> <br />Dear Mr. Brubaker: <br /> <br />On October 20, 2016 the Division of Reclamation, Mining and Safety approved the Technical Revision <br />application submitted to the Division on August 19, 2016, with the exception of the request to allow the <br />existing shop building and concrete aggregate storage bunkers to the south to remain. Without a <br />demonstration that leaving these structures in place is not in violation of county zoning regulations, <br />the Division cannot approve the request to allow these structures to remain. The remainder of the <br />requested changes to the permit are approved, acknowledging that your October 5, 2016 response letter <br />(received October 12, 2016) requested the name of the site not be changed to the MacKenzie Pit. <br /> <br />A brief summary of the changes approved in TR-04 follows: <br /> <br /> Minor reduction in reseeded areas, wildlife habitat end use, modify tree planting and removal <br /> <br />The terms of the Technical Revision No. 4 approved by the Division are hereby incorporated into Permit No. <br />M-1977-559. All other conditions and requirements of Permit No. M-1977-559 remain in full force and effect. <br /> <br />The Division has reviewed the change associated with TR-04 for impacts to the financial warranty and has <br />determined that this change does not require an increase to the current reclamation liability. <br /> <br />If you have any questions, please contact me. <br /> <br />Sincerely, <br /> <br /> <br /> <br />Timothy A.
