The report was submitted on October 7, 2016 via e-mail. According to the <br />submittal, the report was submitted for compliance with Rules 4.09.1(11)(a), 4.09.1(11)(b), 4.10.2(2)(a) and 4.10.2(2)(b). <br />In accordance with Rule 4.09.1(11)(a) the fill was inspected on September 29, 2016 for the third quarter of this year by <br />Timothy Travis with North West Colorado Consultants, Inc. (NWCC). The report noted that a contractor was actively <br />stockpiling and compacting refuse coal in the new Expansion Area in an area above the second bench along the east <br />side of the stockpile. The report noted the contractor was preparing to place cover material for the second bench. <br />I n accordance with Rule 4.09. 1 (11)(b) the report was received by the Division within two weeks after the inspection of the <br />fill. The report indicated that the fill was being constructed in accordance with the plans submitted under Rule 2.05.3(8) <br />in the permit and the potential hazard to human life and property at the site in its present condition is minimal. The <br />report includes a discussion of any appearances of instability, structural weaknesses, and other hazardous conditions of <br />which none were noted. Per the above noted regulation, please retain a copy of this report at the mine site. <br />The report did not indicate if additional construction of the underdrain system occurred. <br />I n accordance with Rule 4.10.2(2)(a) the coal mine waste bank (refuse pile) was inspected for the third quarter of this <br />year. In accordance with subsection (2)(b) of this rule, NWCC provided the results of compaction tests conducted within <br />the Expansion Area. According to the report all of the test taken during this quarter met the minimum compaction <br />requirement of 90%.
