10/18/2016 State.co.us Executive Branch Mail - Re: FW: Scanned from Engineering Trailer
'TT' CE Hernandez - DNR, Alysha <alysha.hernandez@state.co.us>
COLORADO,
Ebert - DNR, Jared <jared.ebert@state.co.us> Tue, Oct 18, 2016 at 8:19 AM
To: "Watterson, Brian" <BWatterson@peabodyenergy.com>
Cc: Alysha Hernandez <alysha.hernandez@state.co.us>
Brian,
I have reviewed the third quarter 2016 pond inspection report submitted for the Foidel Creek Mine, C-1982-056. The
report was received by the Division on October 3, 2016 via e-mail. It appears this report was submitted to comply with
Rule 4.05.9(14), (15) and (17). The impoundments at the site were inspected on September 23, 2016 by you (Brian
Watterson). The report was stamped/certified by Michael Berdine a registered professional engineer on September 28,
2016.
The following are maintenance items that were either noted to have been completed or to be required. Wood was
cleared from the discharge drainage at the Area 1 pond. TC plans to have the cattails removed around the primary
spillway at Pond T. It was noted that concrete was placed around the weir at Pond G to repair short-circuiting around
the devise. The spillway riser at the Fish Creek Tipple Pond was straightened in August. TC will have the embankment
of Pond C raked and re -seeded. TC noted that the barrier upstream of the flume needs to be replaced at Pond B. The
delta at Pond E needs to be cleaned out and removed. The flume at Pond F needs to be repaired by adding concrete to
prevent short-circuiting. There was a clog noted in a pipe at the Waste Water Treatment Pond #3 that will need to be
addressed.
The Division acknowledges the maintenance items that have been completed and agrees with the maintenance items
that remain to be done.
Overall it appears the report is in general compliance with Rule 4.05.9(14) that all impoundments be inspected by a
qualified registered professional engineer or other qualified professional specialist yearly. The report was supplied to the
Division shortly after the impoundments were inspected. Per Rule 4.05.9(14)(c) and (17) please retain a copy of this
report at the mine site.
The pond inspection report forms submitted contain the information required by Rule 4.05.9(15).
Also the report satisfies the requirement that all impoundments be examined at least quarterly by a qualified person
designated by the operator for appearances of structural weakness or other hazardous conditions on a quarterly basis.
Thank you for your submittal,
On Mon, Oct 3, 2016 at 8:58 AM, Watterson, Brian <BWatterson@peabodyenergy.com> wrote:
-----Original Message -----
From: twentymile@peabodyenergy.com[mailto:twentymiie@peabodyenergy.com]
Sent: Monday, October 03, 2016 9:06 AM
To: Watterson, Brian
Subject: Scanned from Engineering Trailer
https://mail.googl e.com/m ai I/u/0/?ui=2&i k=e29129fcb5&view=pt&search= i nbox&th=157d8294108999ec&si m l=157d8294108999ec 1/2
