<br /> The Division determined the Applicant complied with the notice requirements of the Act and Rules. With
<br /> the extensions to the application decision date and associated rescheduling of the formal Board hearing to
<br /> the October 26-27, 2016 Board meeting, an individual who first learned of the application from the public
<br /> notice signs will have had 250 days to review the application, consult with experts, and/or conduct
<br /> research.

<br /> The Act and Rules do not specifically address traffic or traffic safety for roads located off-site from a
<br /> mining operation. Such issues are under the jurisdiction of El Paso County and the Colorado Department
<br /> of Transportation (CDOT). These issues should be addressed through the permitting processes of El Paso
<br /> County and CDOT.
<br /> Pursuant to Rule 6.4.13, the application affirmatively states that the proposed mine operation will obtain
<br /> a Special Use Permit and Construction Permits from El Paso County and a Hwy 115 Access Permit from
<br /> CDOT.
