<br /> On June 14, 2016, pursuant to Rule 1.6.2(1)(f), the Division required the Applicant to provide additional
<br /> notice to the property owners at Eagles Nest and Bauer Ranch, who must travel through portions of the
<br /> affected lands to access their private property. A second public comment period was provided for the
<br /> property owners at Eagles Nest and Bauer Ranch. The second public comment period was open for 20
<br /> days, and closed on July 8, 2016. During the second comment period, the Division received written
<br /> comments from the following individuals:

<br /> 113) On June 29, 2016, the Division received an objection from Michael Spoor, dated June 29, 2016.
<br /> 114) On July 2, 2016,the Division received an objection from Nancy Reed, dated July 2, 2016.
<br /> 115) On July 5,2016,the Division received an objection from Barbara L. Hughes and Judy Kline,dated
<br /> July 3, 2016.
<br /> 116) On July 6, 2016, the Division received an objection from Jean A. Miller,not dated.
<br /> 117) On July 6, 2016,the Division received an objection from Matthew D. Cook, dated June 23, 2016.
<br /> 118) On July 6, 2016, the Division received an objection from Dan and Jodi Murphy, dated April 11,
<br /> 2016.
<br /> 119) On July 7, 2016, the Division received an objection from Lawrence Decker, Trustee of L.D. and
<br /> D.L. Decker Trust, dated June 6, 2016.
<br /> 120) On July 7, 2016, the Division received an objection from Cheryl L. Kimble, dated July 6, 2016.
<br /> 121) On July 8, 2016, the Division received an objection from Benjamin Andrew Simmons and Stacy
<br /> Simmons, dated July 1, 2016.
<br /> The Division forwarded copies of all comments to the Applicant, and scheduled a hearing before the
<br /> Colorado Mined Land Reclamation Board (Board), and a Pre-hearing Conference. The Division provided
<br /> notice of the scheduled Board hearing and Pre-hearing Conference to all parties and interested persons.
<br /> On June 30, 2016, the Division hosted an informal public meeting in Colorado Springs, during which the
<br /> Division explained the application review process, issues under the Board's and Office's jurisdiction,
<br /> party status, and Pre-hearing Conference and formal Board hearing processes. Parties and interested
<br /> persons were informed of the informal public meeting by written notice, provided on June 9, 2016. The
<br /> meeting was well attended by the public.
<br /> The recommendation deadline was extended by request from the Applicant, from August 5, 2016, to
<br /> October 4, 2016. The Division rescheduled the Board hearing and Pre-hearing Conference accordingly,
<br /> and provided timely notice of the new dates to all parties and interested persons in accordance with the
<br /> requirements of the Act and Rules. Pursuant to Rule 1.4.9(2)(c), the Division's recommendation and
<br /> rationale for its recommendation shall be sent to the applicant and to all objectors of record at least three
