De Minimis Condition - A de minimis condition is not considered a Recognized <br /> Environmental Condition (REQ. The condition does not represent a threat to <br /> human health or the environment; and would not be subject to enforcement action <br /> if brought to the attention of a regulatory agency. that would not be considered a <br /> Recognized Envirownental Condition. <br /> Photographs of the areas intended for reuse are attached for your reference. To avoid any <br /> potential water quality impacts, stained concrete will be segregated, evaluated for <br /> appropriate disposal or alternate reuse, and will not be placed in the water on the Site. <br /> 3. Dead Trees. The Division requested an explanation of the method for preventing the <br /> spread of seeds from Russian olive trees throughout the Site.Vern Lindner ordered Russian <br /> olive tree cutting during the winter months(January through March),before the trees would <br /> start flowering in May, creating new viable seeds. The property was then treated in <br /> September by Fremont County Weed Management, which would have addressed any <br /> shoots growing from the recently cut tree stumps; see attached invoice. Stan Peters <br /> contacted Jana Rapetti, Fremont County Weed Management Director, about the concern <br /> for spreading seeds during the mulching & reclamation process. She said since the trees <br /> were cut during the end of the 2016-2017 winter, the seeds were likely already eaten and <br /> spread before the trees were cut, and new viable seeds did not exist. Furthermore, since <br /> the seeds are often eaten and distributed by birds, spreading of seeds in the-future will still <br /> occur from off-property trees, and be treated with routine weed control practices by the <br /> land owner. She did convey that treating the freshly cut stump with herbicide within hours <br /> of tree cutting is the most effective way of minimizing regrowth from the stump. Her <br /> department can be scheduled to apply it, or she would make it available to the tree cutting <br /> crews for them to apply. This new information has been shared with Vern Lindner. Ms. <br /> Rapetti also provided additional information on the property treatment in'September, and <br /> Russian olive trees in general; see attached. <br /> 4. Name Change. The Division noted that another pit in the vicinity is named McKenzie Pit. <br /> For the purposes of TR-04, we will continue to refer to this pit as the "Canon City East <br /> Pit." <br /> If these responses adequately address the Division's concerns,please consider this letter to <br /> supplement and amend TR-04.
