October 12, 2016 <br />COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Interoffice Memo <br />King Coal Mine (Permit No. C-1981-035) <br />2016 Second and Third Quarter Waste Pile/Embankment Inspection Reports Review <br />Rob, <br />I have reviewed the 2016 Second and Third Quarter Waste Pile/Embankment Inspection Reports <br />(Reports) for the King Coal Mine and have found them in compliance with the following Rules: <br />• 4.09. 1 (1 1)(a) — The coal mine waste bank was inspected by a qualified professional <br />engineer during both quarters. Ryan Griglak, P.E., of Stoner Engineering & Surveying, <br />inspected the waste pile on behalf of GCC Energy, LLC. The inspections occurred during <br />the second and third quarter of 2016. <br />• 4.09. 1 (1 1)(b) — The second quarter inspection occurred on June 23, 2016. For unknown <br />reasons, the Division was unable to find documentation of receiving this report. The <br />Division contacted the mine and was able to receive the report on October 12, 2016. The <br />inspection report cover letter for the Second Quarter Waste Pile/Embankment Inspection <br />Report was dated June 27, 2016. The third quarter inspection occurred on September 30, <br />2016 and was received by the Division on October 6, 2016. <br />• 4.09. 1 (1 1)(c) — This rule is not applicable during this phase of waste pile construction. <br />• 4.10.2(1) — Refer to Rule 4.09. 1 (1 1)(a) of this memo. <br />• 4.10.2(2)(a) — Refer to Rule 4.09. 1 (1 1)(b) of this memo. The Division does not require <br />additional inspection frequency for the King Coal Mine waste pile. <br />• 4.10.2(2)(b) — King Coal Mine is required to submit compaction results to the Division at <br />least once every two years. Compaction results were not submitted with these inspection <br />reports. The last compaction report received by the Division was in April 2015, thus no <br />compaction results are necessary at this time. <br />• 4.10.2(2)(c) — Visible evaluation of the waste pile was documented in the Reports.
