Permit# M-1987-113 <br /> On behalf of our client Bestway Concrete, I am submitting the following information as a response <br /> to your�econd Adequacy Review letter dated September 27, 2016. I have included your question and my <br /> re� sponse.in the order presented so we have all of the information in one file. <br /> 1. The Operator is proposing to eliminate surface water runoff which accumulates in the pit by pumping and <br /> discharging the water onto the affected lands. The Operator has stated a stormwater discharge permit will be <br /> required for this activity. Please demonstrate a discharge permit is not required through the Colorado Water <br /> Quality Control Division or commit to obtaining a discharge permit prior to initiating pumping activities. <br /> This plan does not involve discharging stormwater from the Permit area. The plan we will use is to <br /> install a spray system that will jointly serve M-1983-113 and M-1979-045 that will allow the water <br /> trapped in the mined area to be sprayed on the undisturbed vegetation areas around the mine so it returns <br /> to the system naturally. This method has been acceptable since 1994 by the CDPHE to avoid having to <br /> get a direct discharge permit for removing the stormwater that collected in the clay mine. However, if a <br /> discharge permit is needed, the mined is covered by CDPHE Permit NO.
