Jamieson Road
Spokane, WA 99223

Re: Kate Project, DRMS File No. P-2016-019; Notice of Receipt of Application

Dear Mr. Hughes:

On September 19, 2016 the Division of Reclamation, Mining and Safety (Division) received your Notice of Intent
to Conduct Prospecting Operations (NOI) application. The fee was inadequate with the submittal. The Division
received the additional fee on September 22, 2016. The Division posted the non- confidential form (Form 2) on
the Office website on September 23, 2016 in accordance with the requirements of Rule 5.1.3. Any public comment
or request for disclosure of information designated as confidential regarding the NOI must be received by the Office
no later than ten (10) working days after the notice was posted on the Office website (October 7, 2016).

Per the Division’s memorandum of understanding (MOU) with the U.S. Bureau of Land Management (BLM), and
Item VI.2 of the NOI application, I coordinated with the BLM Cañon City field office to ensure no BLM interests
were involved in the proposed prospecting activities. The BLM indicated there are several split estate properties
and claims in the vicinity. As such, the BLM performed a detailed review to verify no BLM interests were involved.
On October 5, 2016, the BLM Office confirmed BLM has interests in the area, but as long as Viscount Resources
drills in the locations shown on the map provided with the NOI application, no BLM managed minerals/surface
will be involved. Hence, on October 5, 2016, the Division considered your NOI application complete for the
purpose of filing. Review for deficiencies began on October 5, 2016.

The Division will begin its review of the NOI and will contact you within twenty (20) working days of the filing
date (November 3, 2016) regarding any deficiencies or if the review indicates the proposed operations are
considered to be mining, rather than prospecting.

If you have any questions or need further information, please contact me at (303)866-3567 x8169.

Sincerely,

Timothy A.
