<br /> <br /> <br />NOTICE OF PROPOSED DECISION <br /> <br /> <br />The Colorado Division of Reclamation, Mining and Safety proposes to approve Transfer of Permit <br />No. 1 (SO-1), submitted by Tri-State Generation and Transmission Association, Inc to a coal <br />mining permit at the New Horizon North Mine. The permit will be succeeded by Elk Ridge Mining <br />and Reclamation, LLC. <br /> <br />The New Horizon North Mine is a(n) surface operation located in Montrose County, approximately <br />2.5 miles Northwest of Nucla. Coal interest is private , and the surface to be affected is private land. <br />The permit area encompasses approximately 328.70 acres. <br /> <br />This proposed decision is based on a finding that the proposed operation will comply with all <br />requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, et seq., <br />C.R.S., and the regula tions promulgated thereunder. <br /> <br />Copies of the proposed decision, including stipulations, are on file for public inspection at the <br />Colorado Division of Reclamation, Mining and Safety, Room 215, Centennial Building, 1313 <br />Sherman Street, Denver, Colorado 80203 and on the Division’s website at <br />http://mining.state.co.us/Reports/MiningData/Pages/ImagedDocumentData.aspx . A user’s guide <br />for our document imaging system is als o available in pdf format at the same web address. <br />Persons with an interest that may be adversely affected by the proposed decision may request a <br />formal hearing before the Mined Land Reclamation Board on the proposed decision. Such request <br />must be made on or before November 2, 2016, must be in writing, and must state with reasonable <br />specificity the reasons for the request and the objections to the proposed decision. <br />
