14301 Brighton Road
Brighton, CO 80601
Sept. 21, 2016
Colorado Division of Reclamation, Mining and Safety
Department of Natural Resources
Tony Waldron
Minerals Program Supervisor
1313 Sherman St. Room 215
Denver, Co 80203
Re: DRMS Permit#M-1987-049 (Bromley Lakes) - Flooding of Spier Property
Dear Mr. Waldron,
This letter is requesting the State of Colorado's Assistance in the finding the source/problem
with the flooding of our property at 14301 Brighton Road, Brighton, Co. 80601, and
providing help/support to rectify the problem, so that it doesn't continue to reoccur.
We are experiencing flooding of the lower portion of our property, which is flooding our cow
barn, chicken coop/yard, and pasture. We have attached several pictures of the flooding to this
email. This problem escalated in the months of July and August 2016.
While we have been working with Joe Lamanna, General Manager Aggregates, for Boral
Aggregates, the water problem continues to persist. Boral Aggregates did pulled three (3)
ditches which have taken some of the water off our property; however, water continues to flow
steadily in those ditches from our property and theirs. Because of these ditches and our use of a
Shop Vac, over many days and many gallons of water, our barn, coop and chicken yard did begin
to dry out. Unfortunately, in the past two (2) days water has begun to pool in our coop and yard
again.
We did reach out to your office on Sept. 12, 2016, when Boral Aggregates failed to reply to an
email about the need to find a solution sent a week earlier. At that point, we felt we had to
obtain you knowledge as to what was causing the water problem, and how to rectify it, especially
as Boral Aggregates appeared stymied as to the cause.
Secondly, in a December 15, 2010 letter sent to Mr. David Bird, it was mentioned that you (Tony
Waldron) had expressed concerns about water mounding impacting our property. So we felt you
were the person we needed to contact, since Mr. Bird was no longer with the Colorado Division
of Reclamation, Mining and Safety.
