Permit# M-1987-113 <br /> On behalf of our client Bestway Concrete, 1 am submitting the following information as a <br /> response to your Adequacy Review letter dated May 2,2016. I have included your question and <br /> my response in the order presented so we have all of the information in one file. Fora various <br /> reasons it has been decided to withdraw only the ditch relocation as part of the Technical Revision. <br /> If the ditches are moved in the future a Technical Revision will be filed to show the new location. <br /> 1 have addressed the adequacy review questions that pertain to other items raised during your <br /> review and adequacy review. <br /> 1. The Reclamation Plan Map contains labels for the final grade of the east slope of the pit. <br /> Please revise the map to include labels for the final grade of the north, south and west slopes. <br /> I revised the existing Reclamation Plan Map that was revised in <br /> 2004 to show the proposed sloping for the mine. I drew them in at <br /> 2h:ly but after reviewing the plan as revised in 2004 they should <br /> have been 3h:1V. I have labeled all of the slopes around the <br /> mine. <br /> 2. The elevation of the labeled contour lines on the Reclamation Plan Map appears to be off by <br /> ten feet. Please revise the Reclamation Plan Map accordingly. <br /> This problem has been fixed. <br /> 3. Pursuant to Rule 6.4.19, where the mining operation will adversely affect the stability of any <br /> significant, valuable and permanent man-made structure located within two hundred feet of the <br /> affected land, the Applicant/Operator may provide a notarized agreement between the <br /> Applicant and the person(s) having interest in the structure. The agreement shall establish that <br /> the Applicant is to provide compensation for any damage to the structure.A review of the <br /> permit file found the Division has no record of a structure agreement for the Upper Church <br /> Ditch and the McKay Ditch. Please provide a signed and notarized structure agreement for the <br /> ditches.Alternately, the Operator may submit an engineering evaluation which demonstrates <br /> the ditches will not be damaged by activities occurring at the mining operation. <br />
