The decision date for this Technical <br /> Revision is October 21, 2016. The Division has reviewed the proposed revisions and has the <br /> following comments: <br /> 1. The Operator is proposing to eliminate surface water runoff which accumulates in the pit by <br /> pumping and discharging the water onto the affected lands. The Operator has stated a <br /> stormwater discharge permit will be required for this activity. Please demonstrate a discharge <br /> permit is not required through the Colorado Water Quality Control Division or commit to <br /> obtaining a discharge permit prior to initiating pumping activities. <br /> 2. The Reclamation Plan Addendum states the concrete batch plant has a separate permit from <br /> Jefferson County and may remain on site following the completion of reclamation. The <br /> Division would like to remind the Operator the current post-mining land use for the site is <br /> wildlife habitat. A change in the post-mining land use would need to be approved through an <br /> Amendment in order for the concrete batch plant to remain after the life of the mine. <br /> 3. The Division has enclosed the revised financial warranty estimate for the Church Pit with this <br /> letter. Please review the enclosed figures for accuracy. Pursuant to Rule 4.2.1(2), the <br /> Division will provide notice of a surety increase under separate cover. <br /> This concludes the Division's preliminary adequacy review of this Technical Revision. Please <br /> remember that the decision date for this Technical Revision is October 21, 2016. As previously <br /> mentioned, if you are unable to provide satisfactory responses to any inadequacies prior to this <br /> date, it will be your responsibility to request an extension of time to allow for continued <br /> review of this Technical Revision.
