PERMIT#: M-2009-093 <br /> INSPECTOR'S INITIALS:MAC <br /> INSPECTION DATE: August 19,2016 <br /> INSPECTION TOPIC: Signs & Markers <br /> PROBLEM/POSSIBLE VIOLATION: Problem: The mine identification sign and affected area boundary markers <br /> were not observed per the requirements of Rule 3.1.12. <br /> CORRECTIVE ACTIONS:The operator must post a sign at the entrance to the mine site which shall be clearly <br /> visible from the access road and specify the following; the name of the operator, indicate that a reclamation <br /> permit for the operation has been issued by the Colorado Mined Land Reclamation Board, and the permit <br /> number. The boundaries of the affected area must be marked by monuments or other markers that are clearly <br /> visible and adequate to delineate such boundaries. <br /> CORRECTIVE ACTION DUE DATE: 10/21/16 <br /> OBSERVATIONS <br /> The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br /> (Division). The Operator was not present for the inspection. The Suzanne Marie mine is located approximately <br /> 20 miles northwest of Wellington, Colorado in Larimer County. The site is situated within Larimer County Red <br /> Mountain Open Space. The site is permitted for 9.9 acres and the commodity of interest is gypsum. <br /> Availability Of Records: <br /> As noted above, the Operator was not present for the inspection. The Division was informed prior to the <br /> inspection that Mr.James Theisen, the inspection contact, was deceased.The Permittee shall update the <br /> Division with a new point of contact for Inspections, Permitting and Permittee/Operator. In addition, the <br /> Permittee is no longer registered with the Colorado Secretary of State. A copy of the Registration Summary <br /> from the Secretary of State has been enclosed with this report. If the Permittee is no longer a valid entity <br /> authorized to conduct business in Colorado, then the Reclamation Permit for the Suzanne Marie site must be <br /> transferred to a viable entity or individual through the Succession of Operators Process. These issues have <br /> been cited as a problem and will require corrective action; please see the first page of this report for <br /> additional information. <br /> Financial Warranty: <br /> The Division currently holds a financial warranty in the amount of$2,681.00. As a part of this inspection the <br /> Division will conduct an evaluation of the financial warranty to ensure that it is adequate to complete <br /> reclamation. Notice of a financial warranty increase will be sent under separate cover. <br /> Gen. Compliance With Mine Plan: <br /> The mine was not operational at the time of the inspection and no equipment was observed. The Suzanne <br /> Marie operation has received approval for intermittent operation.The active quarry area appeared to be <br /> located towards the eastern end of the permit area, to the south of the access road. The Operator is quarrying <br /> into a hillside with a northerly aspect. The exposed face of the quarry is approximately 15 ft. in height and is <br /> nearly vertical. The Division observed several stockpiles of topsoil north of the mine face.The Division <br /> estimates there is less than 250 cubic yards of material which would need to be backfilled against the mine <br /> face. The site is largely stable and the Division did not observe any erosion within the quarry. To date, the <br /> Operator has affected approximately 0.25 acres of the 9.9 acre permit boundary. <br /> Page 2 of 5 <br />
