(Tri-State) has received Mr. Jared Ebert's <br />adequacy letter for SO -01 dated September 19, 2016, and provides the below responses on behalf of Elk <br />Ridge Mining and Reclamation, LLC, New Horizon North Mine. The New Horizon North Mine operates <br />under Permit No. C-2010-089. <br />1. Please revise page 2.03-3 to contain a statement that the applicant (Elk Ridge Mining and <br />Reclamation, LLC) is a Limited Liability Company in accordance with Rule 2.03.4(1). <br />Response: Under Section 2.03.4(2)(a) on Page 2.03-3, Elk Ridge is called out as "Elk Ridge Mining <br />and Reclamation, LLC" on the first line of the section. "LLC" is a widely accepted acronym for a <br />Limited Liability Company, and inclusion of this already demonstrates compliance with Rule <br />2.03.4(1). Therefore, no change has been made. <br />2. Please provide the name and employer identification number of the individual or company that <br />will pay the abandoned mine reclamation fee for the New Horizon North Mine in accordance <br />with Rule 2.03.4(2)(b). The current revised page does not include this information. <br />Response: Rule 2.03.4(2)(b) states, "Applicant's resident agent; and". It is believed that the <br />Division intended to quote Rule 2.03.4(2)(c). As staff can turnover at an operation a name has not <br />been provided in Section 2.03.4(2xc), but the employer I.D. for the New Horizon Mine has been <br />added. <br />3. On proposed revised page 2.03-9, please provide the address for the Trapper Mine under section <br />2.03.4(4)(a). <br />Response: The address for Trapper Mine has been added as requested. <br />4. The applicant submitted a copy of the Tri-State Board Resolution for Western Fuels -Colorado, <br />LLC that cited the approval of the change of the name of the company to Elk Ridge Mining and <br />Reclamation, LLC. This resolution should be made part of the permit. Please submit this <br />document as an appendix to Section 2.03 of the permit.
