COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />September 27, 2016 <br />Brian Watterson <br />Twentymile Coal, LLC. <br />29515 Routt County Road 27 <br />Oak Creek, CO 80467 <br />RE: Foidel Creek Mine; C-1982-056; Technical Revision TR85 <br />Hydrologic Monitoring Reductions, Adequacy Review No. 1 <br />Dear Mr. Watters on: <br />The Colorado Division of Reclamation, Mining, and Safety (Division) has reviewed the above referenced <br />Technical Revision. Overall, it appears the majority of the revision revised text in Exhibit 14 that does <br />not directly correlate to the proposed revision discussed in the cover letter to TR85. Exhibit 14 has been <br />reorganized and reworded. It is unclear why these revisions were made to Exhibit 14 as they largely do <br />not have anything to do with the stated purpose of the revision. The following items will need to be <br />addressed prior to the Division's approval of the revision. <br />According to Exhibit 04E-11, Wells AVF-14 and AVF-15 and surface water monitoring site SW - <br />14 and SW -15 will be used to measure impacts from mining in the Wolf Creek Reserve. <br />Twentymile Coal, LLC. (TC) requests to deactivate monitoring at alluvial walls AVF-14 and <br />AVF-15 and two stream water monitoring site SW -14 and SW -15. As these wells are used to <br />measure mining impacts from mining in the Wolf Creek Reserve, it would not be appropriate to <br />deactivate these sites at this time. Please update revised Exhibit 14 to indicate monitoring at the <br />currently approved frequency will continue at these sites. Also, please either retractor update the <br />proposed revised permit text to indicate these site were not deactivated. <br />2. TC proposes to discontinue monitoring at the Jones well due to the fact that they provided Mr. <br />Jones a water tank and imported water for him so he no longer has to use this well for potable <br />water. Does TC intent to provide Mr. Jones or his successor water in perpetuity? How will TC <br />insure this well will no longer be used? Please update Section 2.05.6 of the permit to contain a <br />description of the measures to be used after mining and reclamation activities to ensure the <br />protection of the right of the present users of this alluvial well in accordance with Rule <br />2.05.6(3)(a)(ii).
