Resolution:
STAFF SUMMARY. -
On July 6, 2015 the Division of Reclamation, Mining and Safety approved the application for a
new I I2(c) permit located in La Plata County. The operator failed to post the financial warranty
within 365 days of the approval. In accordance with C.R.S. 34-32.5-117 (1) and Rule 4.1 (2) of
the Rules for the Extraction of Construction Materials the decision to approve the application
shall be reconsidered by the Mined Land Reclamation Board. The re -notice procedures have
been completed in accordance with C.R.S. 34-32.5-112(9) (c) and Rule 1.6.2 (1) (e) of the Rules
for the Extraction of Construction Materials.
STAFF RF.COMMENDATION.

No comments or objections were received.
The operator has submitted the Performance Warranty and the required Financial Warranty in
the amount of $225,851.57. Division review of the documents finds them complete and
acceptable. Staff recommends that the Board reaffirm the approval of the application M-2015-
001 for the new 112 (c) permit and direct the Division to issue the permit.
