The site consists of a former coal train load <br />out and haul road. The train load out/load in has not been used for many years and all loading facilities except the <br />track were previously reclaimed. HGT is currently pulling the train rails, ties and ballast. A contractor, S& S <br />construction is conducting the demolition work. Mine personnel were not on the property at the start of the <br />inspection, but when problems were encountered, the contractor contacted the operator, Bran Watterson and <br />Miranda Blomquist of HGT came to the site to represent the operator. <br /> <br />The haul road is no longer used for coal haulage. Although it is a private road, local traffic consistently uses the <br />tie-across haul road. The operator has an agreement with Routt County Road and Bridge, that the County <br />conducts grading and other maintenance on the road. <br /> <br />The weather was clear and dry at the time of the inspection. <br /> <br /> <br />BACKFILL and GRADING – Rule 4.14 <br />Contemporaneous Reclamation 4.14.1; Approximate Original Contour 4.14.2; Highwall Elimination 4.14.1(2)(f); <br />Steep Slopes 4.14.2, 4.27; Handling of Acid and Toxic Materials 4.14.3; Stabilization of Rills and Gullies 4.14.6: <br /> The contractor was on site at the time of the inspection, pulling rail, The operator is removing rail and <br />storing in laydown areas adjacent to the existing tracks. Ties are removed and stored in stacks in several areas <br />near county road access points. Two of these laydown areas are located outside of the approved permit area <br />boundary. See map Exhibit 12-1 “Facilities Map”. One laydown area is located adjacent to RCR No. 37, in the <br />NE 1/4 Section 10, North of the Walker ditch, south of Highway 40, and west of the approved permit boundary. <br />The Division estimates this area is approximately 1.5 acres. Pacing measured the area as approx. 400 feet north to <br />south by 160 feet (east to west). <br />Exhibit 3-1 shows that the surface owner of this property is Hayden Gulch Terminal, LLC.
