Tetra Tech Memo, Page 3, Parag_raph 6 <br /> The consistent issue to be addressed by the Al plan is not surface water but groundwater <br /> inundation. It only took one year for the groundwater to go from as much as 7.50 feet below the <br /> ground to making the closest monitoring wells to the Orr Property inaccessible. By 2011 the <br /> water depth was 3.5 feet above the surface on the Orr Property—an 11 foot increase. <br /> J. Tetra Tech Memo, Page 4, Paragraph 1 <br /> It appears that the spill way and potential reservoir elevation will be 5040.8 or 4.8 ft. (58 <br /> inches) higher than the proposed out let pipes. If so, then should the pipes be blocked, the base of <br /> the Orr Property drain pipe will also be 58 inches below the potential reservoir elevation and <br /> under water. The result is that reservoir water will like likely transfer back into the Bull Seep <br /> and precipitate flooding on the Orr Property. This prevents the relief sought by Equity Funding <br /> and will incidentally give the owner of the reservoir incentive to bypass the pipes in the future. <br /> IV. Conclusion <br /> On the basis of the above, Equity Funding does not approve of the Application <br /> Amendment as proposed. Unless and until the changes suggested above are made, including an <br /> amendment of AI's 404 Permit, Al will continue to be in violation of the orders of this Board, <br /> state and Federal law. <br /> Page 5 of 5 <br />
