<br />PART I.
<br />THIS MODIFIED COAL, LFAS8 is entered into on SEP 2 8 by and between the UNIILD STATES OF AMERICA,

<br />hereinafter called Lessee,
<br />This modified lease shall retain the effective date October 25,191-74, of the original COAL LEASE D- 034365, and is effective fur a
<br />period of 20 years therefrom, and for so tong thereafter as coal Is produced in conuncreial quantities from Elie leased lauds, subject to
<br />readjustment of lease terns at the end of the 20th lease year (Octobci 25, 1944), and each 10 -year period ihoreaftcr.
<br />Sec, 1. This lease is issued pursuant and subject to the terms and provisions of the Mineral Lnrids Leasing Act of 1920-1s, amended,
<br />41 Stat. 437,30 U,S.C. 181 -287, hereinafter referred to as the Act; and to the regulations and formal orders of the Secretary nfthe Interior
<br />which are now or hereafter in force, when not inconsistent with the express and specific provisions liereln.
<br />Sec. 2. Lwce as the holder of Coal Lease D- 034365, issued effective October 25,19Z4, was granted the exclusive right and privilege
<br />to drill for, mine, extract, remove or otherwise process and dispose of Elie coal deposits in, upon, or under the lands described below as
<br />Tract 1.
<br />The J cssor in consideration of fair market value, rents and royalties to be paid, and the conditions and covenants to be obsel vcd as
<br />herein set forth, hereby grants aid leases to lacsee the exclusivu right and privilege to drill for, mine, extract, remove, or otherw6o
<br />process and dispose of the coal deposits In, upon, or under the lands described below as Tract 2.
