AA <br /> VV <br /> MineWater <br /> September 16, 2016 RECEIVED <br /> Mr. Andy Lensink, Enforcement Attorney SEP 16 2016 <br /> Mr. Douglas Naftz, Enforcement Attorney <br /> Mr. Kerry Guy, On Scene Coordinator DIVISION OF RECLAMATION <br /> United States Environmental Protection Agency MINING AND SAFETY <br /> Dear Sirs, <br /> MineWater LLC (MineWater), is the contractor for MineWater Finance LLC at the London <br /> Mine cleanup project. MineWater Finance LLC is the bona fide prospective purchaser(BFPP) <br /> for the London Mine which was historically mined from the 1870s at various times until 1991. <br /> Since that time the property has fallen into abandonment and has a tunnel (the Water Tunnel) <br /> which is, according to the CDPHE, the number one industrial discharge violator/polluter in the <br /> State of Colorado. <br /> MineWater seeks comfort and assurances that in the course of cleanup, waste recovery and <br /> recycling at the property and in the course of additional non-tributary water development around <br /> the former mine, that MineWater LLC as contractor, and MineWater Finance LLC as the BFPP <br /> for the London Mine properties, will not create CERCLA liability for either entity as future <br /> owner or operator, if we do the following Reasonable Steps: <br /> 1. Comply with our obligations as a voluntary signatory to the Compliance Order on <br /> Consent and Settlement Agreement overseen by CDPHE Water Quality Division <br /> including: <br /> a. Managing, repairing and eliminating mine collapses which presently are <br /> impounding contaminated sediments and pose the threat of a catastrophic blowout <br /> of contaminants into South Mosquito Creek from <br /> i. the 0205 drift, <br /> ii. the main Fault crossing in the Water Tunnel and <br /> iii. at the Portal <br /> b. Consolidate the two permitted discharges (CO-0045209 and CO-0038334), which <br /> presently arise from one source area, into one discharge (CO-0038334); <br /> c. Implement the in-situ treatment of hazardous materials (including but not limited <br /> to cadmium and zinc)within the mine pool, as permitted under the Authorization <br /> by Rule previously received in May 2014 from US EPA Region 8 UIC program, <br /> to prevent discharge in excess of discharge standards; <br /> Service yard—10924 Leroy Drive, Northglenn CO 80233 <br /> PO Box 3729, Englewood CO 80155 <br />
