Pineoa <br />Director <br />In addition to the bond release notification requirements outlined in Rule 3.03.2(1) and the April 18, <br />1995 "Guideline Regarding Selected Coal Mine Bond Release Issues, the following clarification is being <br />provided for assistance in determining where to send written notifications of bond release requests. <br />• Adjoining property owners —at a minimum, those owners of land adjoining the requested bond <br />release parcel <br />• Surface owners— at a minimum, owners within and adjacent to the requested bond release <br />parcel. <br />• BLM and Forest Service - if they own the bond release parcel or lands adjoining the bond release <br />parcel. <br />• Local government bodies, municipalities, regional planning commissions, boards of county <br />commissioners, county planning agencies, sewage and water treatment authorities, and water <br />conservancy and water conservation districts in the locality of the mine — Based on the entire <br />permit area, for each county of the permit area (if a permit area is located within more than one <br />county). <br />Additionally, the description of the bond release parcel included in the notifications must be at the <br />metes and bounds level of detail. The description may include a map, but the map will not replace the <br />requirement for a description in metes and bounds. <br />For mines with federal lands, a copy of the bond release application must be provided to the Office of <br />Surface Mining. <br />Should you have any questions or need additional information, please contact me. <br />Sincerely, <br />David A.
