If the staff does, indeed.recommend approval of the permit, I would ask that you consider the following <br /> conditions for approval: <br /> I) Transit Mix must first obtain written permission from easement owners before they realign our road. <br /> Our road easement location and width are defined by a 1968 court decree. Transit Mix has indicated <br /> that they,plan to realign 400 feet of our easement road near where their new quarry road will intersect <br /> our road. In meetings with neighbors, they have also verbally, mentioned realigning our road near the <br /> proposed Highway 115 access point. though that possible realignment is never mentioned in the <br /> written application. <br /> 2) Hitch Rack Ranch owners must agree, in writing, that they,will assume responsibility for maintaining <br /> the ditches in the pits and stockpiles after the life of the mine. Otherwise, lack of maintenance of <br /> those ditches may result in flood damage to our road. <br /> 3) Transit Mix must agree to perform pre-blast surveys for all structures within one mile of the quarry. <br /> At the 30 June public meeting, CDRMS staff indicated that pre-blast surveys would be done for all <br /> structures within one mile of the quarry. The current Pre-Blast Survey Plan only offers pre-blast <br /> surveys for structures within one-half mile of the quarry. <br /> 4) Transit Mix must commit to a water monitoring plan for the life of the quarry. The current Surface <br /> Water and Ground Water Monitoring Plan only describes monitoring for 15 months rather than for <br /> the full life of the quarry. <br /> 5) Transit Mix must commit, in writing, to repair any future damage to the easement road, without <br /> requiring the easement owners to first prove that the damage was caused by quarry operations. <br /> Transit Mix has made several statements, in their adequacy reviews responses as well as in public <br /> meetings and private conversations with landow ners, about maintenance and repair work that they, <br /> may do on the easement road.
