on the River side of the structure, the level will drop slowly enough that the outflow of the structure
(27 cfs) will never flow down an erosive slope; it will encounter the high water level on the River
side. The water will recede slowly compared to the outflow of the structure such that the flow from
the structure will stop well before the River goes back to its normal bank level. For this reason, no
erosion will occur and this side of the structure will not need armoring.
Once mining and reclamation is complete, the structure will be left in place as protection of the
reclaimed slopes. The reclaimed condition of this site is either a lake, roughly 10 feet below the
natural grade, or a swale of roughly the same size and type. In both conditions, the flowrate to fill
the empty space within the pit with floodwater will be significantly less than the 27 CFS that the
stricture is designed for. No modification of the structure will be needed for post mining.
See Map C-4 for technical details.
Exhibit M—Other Permits and Licenses
11. Adequate-Please be reminded that the Division will need a copy ofyour well permitprior to
exposingground water.
Noted.
Exhibit S —Permanent Man-made Structures
12. No agreements are attached. Please submit the referenced agreements as available. Withoutan
agreement no mining may occur within 200ft of a feature or as stated in the geotechnical survey.
Proof of contact and signed structure agreements are being provided to DRMS as they are received.
13. Rephrase items I and 2 to include the Union Pacific right ofway(railroad and culverts)and Excel
easement(powerpoles)on the structure list.
See the attached revised Exhibit S.
Geotechnical Stability Exhibit
14. Please clarifyparagraph one of the exhibit. The two instances appear to be contradictory. In
instances where the permit boundary and the property line are the same will a 30 ft or I00ftsetback
be used?
No mining will take place within 100 feet of the permit boundary. However, topsoil stripping
associated with stockpile construction will happen in areas within 100 feet of said boundary. No
disturbance will take place within 30 feet of the property line, with the exception of the site access.
The Geotechnical Stability Exhibit has been revised to reflect this.
15. Where no structure agreements can be obtained what setbackfromfeatures will be used?
If not structure agreement can be obtained, Elam will maintain a minimum 30 foot setback.
Currently, no structure is closer than 40 feet to the planned mining pits.
Public Notice
16. Provide the Division with proof that all owners of record were properly noticed.Per Rule
1.6.2(1)(d)
a. Which property does the notice to NicholasPysio go with?
Sonic landowners beyond 200 feet from the affected area were noticed in a conservative effort to be
thorough
b. Please notice whoever owns the easement southeast of thesite.
