9/7/2016 State.co.us Executive Branch Mail-RE:Lyons Quarry
Thank you for sharing this information, I don't believe the presence of the northern leopard frog has been included in the
permit file. Has this information been transmitted to Aggregate Industries? Also, would your wildlife biologist be able to
send us some formal documentation on the presence of the frog (if they are still there), so that we may include it in the
permit file? Upon receipt of this documentation, the Division can require the Operator to submit a Technical Revision to
address this finding. The Division does not have a specific policy in place regarding the presence of rare, threatened or
endangered species. However, Rule 3.1.8 requires that all aspects of the mining and reclamation plans take into account
the safety and protection of wildlife on the mine site. The Division would seek specific recommendations from CPW, or
other agencies as appropriate, as to how to best protect this species.
Regards,
Michael Cunningham
Environmental Protection Specialist III
COLORADO
Division of Reclamation,
A&17 Mining and Safety
P 303.866.3567 x8116 I F 303.832.8106
1313 Sherman Street, Room 215, Denver, CO 80203
michaela.cunningham@state.co.us I www.mining.state.co.us
On Fri, Apr 22, 2016 at 3:41 PM, Strenge, Ernst <estrenge@bouldercounty.org> wrote:
Michael,
One our wildlife biologists at Parks & Open Space informed me that the pond at Lyons Quarry referred to in your
inspection report contained a breeding population of Northern Leopard Frog (Rana pipiens) prior to the flood, and
they may still be present. She noted the Northern Leopard Frog is classified as a Tier 1 "species of most concern" by
the State of Colorado and is currently a candidate for federal protection in the western USA. Her recommendation is
that, if they are still present, any work at the pond should be delayed until the young have dispersed, which is
typically by mid-late October.
Is there any DRMS policy around how to handle sensitive species like this? Are you required to coordinate with the
Colorado Parks and Wildlife?
I believe our biologist will conduct surveys of the pond soon to verify if they are still present, and once she does, I can
let you know the results.
If you have questions, let me know.
hftps://mail.google.com/mail/u/0/?ui=2&ik=3ald83e556&view=pt&search=inbox&th=15700f744c94f369&siml=15700f744c94f369 2/4
