ISAACSON ROSENBAUM P.C. <br /> Mr. Michael Zopf <br /> Department of Environmental Health <br /> Routt County <br /> March 30,2009 <br /> Page 2 <br /> Special Use 1) 1986: Approved by Routt County Resolution No. 86-P-043 (copy <br /> Permits: of permit unavailable) <br /> 2) 1990: Permit No. 90-225 <br /> 3) 2000: Permit No. 00-331 <br /> Background <br /> In 1986,Wyman applied for and received from the Routt County Board of Commissioners a <br /> Special Use Permit to operate the Facility,which consists of commercial waste disposal ponds <br /> for the treatment of oil well production fluids. In 1987,Routt County issued a Certificate of <br /> Designation to Wyman for the Facility, in compliance with the Colorado Solid Waste Disposal <br /> Sites and Facilities Act(C.R.S. §§30-20-101,et seq.)(the"Act").From approximately 1987 to <br /> 2003,Wyman operated the Facility. Wyman has not accepted any new commercial waste at the <br /> Facility since approximately 2003. Wyman now seeks to submit plans for the closure and post- <br /> closure care of the Facility to Routt County and CDPHE. Section 17 of the CDPHE regulations <br /> requires Wyman to submit an application to Routt County to amend its Certificate of Designation <br /> for the Facility to incorporate the requirements of the CDPHE regulations by March 30,2009. <br /> Closure Plan <br /> Wyman has notified CDPHE of its intent to submit formal plans for the closure and post-closure <br /> care of the Facility on or before April20,2009 (the"Closure Plan").The Closure Plan will <br /> comply with all applicable CDPHE regulations pertaining to closure and post-closure care of the <br /> Facility. Wyman has contracted with Stewart Environmental Consultants,Inc.to develop the <br /> Closure Plan.Enclosed is an outline of the contents of the Closure Plan. Upon completion of the <br /> Closure Plan,the same will be submitted to both Routt County and CDPHE. <br /> Upon receipt of this application,we hereby request that Routt County provide to CDPHE written <br /> notice of your receipt of this application and a request for CDPHE's technical review of the <br /> Closure Plan upon its receipt by CDPHE.Please also advise the undersigned what additional <br /> steps,if any,Wyman needs to take to satisfy Routt County with regard to Wyman's special use <br /> permits and certificate of designation for the Facility. <br /> 2055675_l.doe <br />
