The Division issued its Proposed Decision to approve the RN -02 application on <br />1/21/94, which meant that the RN -01 permit expired on 1/25/94 (because Final Approval of the RN -02 application had not <br />yet been granted by 1/25/94). To keep mining under an expired permit, Basin Resources obtained temporary relief from <br />the Colorado Mined Land Reclamation Board. <br />Meanwhile, an objector filed an appeal of the Division's Proposed Decision to approve the RN -02 application. This <br />appeal was filed with the Mined Land Reclamation Board. Negotiations between DRMS, the objector and Basin <br />Resources occurred from February through May of 1994, culminating in the Board approving a modified version of the <br />Division's Proposed Decision at the Board's May 1994 meeting. The Board's Order was signed 6/22/1994. The RN -02 <br />permit was issued soon after. <br />Because the RN -01 permit expired, the RN -02 permit was issued with a five-year permit term that began with the date of <br />the Board Order (6/22/1994) and ended five years later (6/22/1999). This is why the RN -02, RN -03, RN -04 and RN -05 <br />permits were issued with June 22nd, rather than January 25th, as the date the permit terms for those permits began and <br />ended. <br />When the Division last summer approved the RN -06 Permit Renewal application, the permit issued following Final <br />Approval of that application was issued with a four-year permit term (rather than five), from January 25, 2015 through <br />January 25, 2019. This was done because it was thought that the June 22nd - June 22nd permit terms were erroneous <br />(it was intended that this "corrected" permit actually have a five-year permit term, from January 25, 2014 - January 25, <br />2019, to overlap with the June 22, 2014 end date of the RN -05 permit; the fact that the "corrected" permit was issued <br />with a four-year permit term was actually another error). <br />As explained above, the June 22nd - June 22nd permit terms that began with the RN -02 permit were in fact correct. <br />That is why you will be soon receiving 2 copies, signed by our Division Director, of the RN -06 permit, re -issued with a <br />permit term that commenced on June 22, 2014 and will end on June 22, 2019 (these re-established permit term dates <br />incidentally establish December 19, 2016 as the date of our Mid -Term Review for this re -issued RN -06 permit). Please <br />sign and notarize both copies of these re -issued permits, and return one to us.
