MANAGEMENT <br />The DRMS' letter dated April 26, 2016 transmitted its adequacy comments regarding the <br />referenced permit revision. Following are Snowcap Coal Company's (SCC) responses to the <br />DRMS' comments and concerns: <br />PR -6 PRELIMINARY ADEQUACY REVIEW COMMENTS <br />2.03.6 — Right of Entry and Operation Information <br />1. DRMS: The PR -6 cover letter and text on page 15-1 indicate that the North Portal area land <br />has been sold to the Town of Palisade. The "surface landowner's consent" letter submitted with <br />the PR -6 application was signed by the vice-president of SCC, but SCC is not the owner of <br />record. A letter from the Town of Palisade will be needed giving SCC the right of entry to the <br />North Portal area. <br />SCC: SCC and Town of Palisade (TOP) currently have a "Contract for the Sale and Purchase <br />of Real Estate", in which SCC has agreed to sell and TOP has agreed to purchase the properties <br />in which the North Portal area is a part. Closing of the sale has yet to been finalized, so SCC will <br />continue as owner of record until closing is complete. The current contract, and the subsequent <br />deed at time of closing, gives SCC the right of entry to the properties until those affected lands <br />have been fully released by DRMS. Within 30 days of closing, SCC will submit a letter from TOP <br />addressing SCC's right of entry onto the property. Depending on the status of PR -6 at time of <br />closing, this will be submitted through PR -6 or through a minor revision. The text on pages 14-11 i <br />and 15-1 has been revised to indicate that SCC is in the process of selling the property. <br />2. DRMS: New surface and sub -surface ownership (if applicable) maps need to be updated to <br />reflect the change in ownership. <br />
