6. The Applicant did not include any information for Exhibit G. Pursuant to Rule 1.10(1),the Applicant will not be required to submit any information which duplicates applicable previous submittals. However,the Applicant shall clearly describe where in the original application the information not included in the Amendment Application, but necessary to render the Amendment technically adequate, may be found. Please revise Exhibit G accordingly. Response: Exhibit G—The applicant has provided the water information just as it appeared in the originally approved application and is included in this resubmittal to be added to the amendment application. 7. The documentation included under Exhibit Q does not conform to the requirements of Rule 1.6.2(1)(a)(ii). Please provide proof that notice of the Amendment Application was sent to the local Board of County Commissioners and the Soil Conservation District. Proof of notice shall be in the form of a return receipt of a certified mailing or a date-stamped copy of the notice acknowledging receipt by the appropriate Board. Response: Exhibit Q—Proof of mailing notices to the Board of County Commissioners and Soil Conservation District has been provided by producing the"Certified Mail Receipt"for each. 8. The Applicant did not submit proof the Amendment Application was filed with the County Clerk and Recorder for public review. Proof of filing shall be an affidavit or receipt indicating the date on which the Amendment Application was placed with the County Clerk and Recorder for public review. Response: Exhibit R—Hand delivered the Amendment Permit to Lorimer County Clerk and Recorder for public review. They stamped and signed my transmittal for proof of the date it was submitted to them.See included stamped and signed transmittal. 9. The Applicant did not include any information for Exhibit S. Please revise Exhibit S accordingly. Response: Exhibit S—The previous application did not address the man-made structure information required to satisfy Exhibit S. To satisfy Exhibit S with this submittal, we have listed all man-made structures within 200'of the mining operation. There are two structures that require structure agreements in place; a. County Road 27 along the east boundary of the quarry.A structure agreement has be hand delivered to the office of Mark Peterson, Lorimer County Engineer,for his signature,included with this submittal is the unsigned version of the structure agreement, will mail the signed copy as soon as we receive it. b. The overhead power lines and poles along the west side of County Road 27 are also within the 200'.A structure agreement has been sent to Poudre Valley REA Electric to be signed by John Bowerfind, we have included the unsigned version of this structure agreement and will mail the signed copy as soon as we receive it.
