P5 SEP 0 2 2016 <br /> DMSION OF RECLAMA71ON <br /> MINING AND SAFETY <br /> City of <br /> Greeley <br /> September 1, 2016 <br /> Mr. Peter Hays <br /> Division of Reclamation Mining and Safety <br /> 1313 Sherman Street, Room 215 <br /> Denver, CO 80203 PC�— <br /> Dear Mr. Hays: <br /> Thank you for meeting with us last week to discuss bank stability issues associated with and <br /> flood damage resulting from the Division of Reclamation Mining and Safety(DBMS) permit <br /> number M-1992-069 it operated by Aggregate Industries—WCR, Inc. (AI). This pit is located <br /> in the City of Greeley, north of F St. and west of N 35`"Avenue, in the floodplain of the Cache la <br /> Poudre River. A City of Greeley(City) agricultural field is located immediately west and <br /> upstream of the AI pit and the Boyd Irrigation Company's (BIC) Boyd-Freeman Ditch is located <br /> adjacent to the western boundary of the AI pit. <br /> Enclosed with this transmittal letter please find three copies of a Wright Water Engineer's <br /> assessment of flood damage to the City's agricultural field and the BIC's ditch and analysis of <br /> the causes of that damage for your review and reference. <br /> As discussed, the Al pit does not comply with DRMS erosion protection and reclamation <br /> requirements and has caused damage to City and BIC infrastructure. As a result, the City and <br /> BIC are requesting DRMS require Al to comply with DRMS requirements by: <br /> • Stabilizing an unstable, eroded gravel-pit embankment <br /> • Repairing attendant erosion on City property <br /> • Stabilizing the BIC ditch located adjacent to the pit <br /> • Reimbursing BIC for erosion-repair costs incurred to date <br /> The City and BIC appreciate the DRMS' assistance addressing these issues, and we request a <br /> follow-up meeting to answer any questions that you have and discuss the conclusions of this <br /> report.
