Brubaker <br />Valco, Inc. <br />9296 Windhaven Dr. <br />Parker, CO 80134 <br /> <br />Re: Project, Permit No. M-1977-559; <br /> Technical Revision (TR-04) Preliminary Adequacy Review <br /> <br />Dear Mr. Brubaker: <br /> <br />On August 19, 2016 the Division of Reclamation, Mining and Safety received a request for a Technical <br />Revision (TR-04) addressing the following: <br /> <br />Minor reduction in reseeded areas, wildlife habitat end use, modify tree planting and removal, <br />change name to MacKenzie Pit <br /> <br />The submittal was called complete for the purpose of filing on August 23, 2016. The decision date <br />for TR-04 is Sept 22, 2016. Please be advised that if you are unable to satisfactorily address any <br />concerns identified in this review before the decision date, it will be your responsibility to request <br />an extension of the review period. If there are outstanding issues that have not been adequately <br />addressed prior to the end of the review period, and no extension has been requested, the Division will <br />deny this Technical Revision (TR). <br /> <br />The following comments are based on the Division’s review of the request for TR-04: <br />1) Fremont County zoning regulations. The second bullet under “Requested Changes to <br />Reclamation Plan” indicates the aggregate storage bunkers will remain “to the extent allowed <br />be Fremont County zoning regulations”. Please demonstrate the intent to leave these structures <br />in place is not in violation of county zoning regulations. <br />2) Structures previously used for fuel and oil storage. The third bullet (p. 1 of Attachment No. 1) <br />and the fourth bullet (p. 2 of Attachment No. 1) under “Requested Changes to Reclamation <br />Plan” indicates that concrete which may have been exposed to petroleum product spills may <br />be rubblized and used in the water for stabilization and/or fish habitat. Please demonstrate this <br />concrete has not been exposed to petroleum product spills. <br />3) Dead trees. The second bullet (p. 2 of Attachment No. 1) under “Requested Changes to <br />Reclamation Plan” states dead trees stockpiled in the plant area will be mulched and distributed <br />with the reclamation process. Please explain how seeds from Russian olive trees will be <br />prevented from being spread throughout the site during this process.
