ATTACHMENT 5. <br /> EXHIBIT L. Permanent Man-Made Structures <br /> NOTE: There was no Exhibit L in the original application, although the access road and fences were <br /> discussed in the various exhibits and correspondence. Please refer to Map Sheet E-8 in Exhibit E. <br /> The following permanent man-made structures existed at the time of the original permit in 1985. <br /> 1. Access Road from SH-3, including both branches of that road (to the J&J Pit and to the house <br /> to the south). <br /> 2. Scale installed adjacent to the access road,just west of the permit boundary. <br /> 3. Fence, 3-strand barbed-wire, located on the east and north edge of the affected area. The <br /> portion of the fence along the north side was abandoned circa 2000 when item 4 was built. <br /> The following permanent man-made structures have been constructed/placed within 200 feet of the <br /> affected area since 1985. <br /> 4. Metal pipe fence, along a portion of the north edge of the affected area, which is associated <br /> with item 5. <br /> 5. Barn and corrals, located to the north of the affected area. <br /> 6. Two powerline poles, constructed near the northwest corner and central north edge, <br /> providing power to the scale. <br /> 7. House and workshop located south of the affected area. <br /> 8. Sheds and additional outbuildings associated with the scale. Although not all are actually <br /> permanent in nature, they are included for sake of completeness. <br /> Items 1, 2, 3, 7, and 8 are owned by Jim and Sharon Helmericks, the Operators. <br /> Items 4 and 5 are owned by Rolling Thunder Group LLC, POB 4582, Durango, CO 81302. <br /> Item 6 is owned by LaPlata Electric Association, 45 Stewart Street, Durango, CO 81303,the <br /> cooperative to which the Helmericks (and neighbors) are members, and which supplies power to the <br /> permit area and adjacent property. <br /> The major concerns are the powerline poles. Recommendations in the Geotechnical Stability Exhibit <br /> address that concern. Secondary concern is the north fence and the corrals/barn beyond it. <br /> It is recommended that indemnity agreements be requested from LaPlata Electric Association, Rolling <br /> Thunder Group, and the Helmericks (as landowners)to cover these permanent structures. <br /> Technical Revision to M1985-001 J&J Pit, LaPlata County, dated 24 AUG 2016 Page 22 <br />
