LARRY W. CROWDER C0N1MI"I'FFES
State Senator OF.COLO`
Vice Chair of
State Capitol 0 Health and Human Services
Denver, Colorado 80203 `" Local Government
303.866.4875 *
larry.crowder.senate@state.co.us
1876
SENATE
STATE OF COLORADO
DENVER
RECEIVED
Colorado Division of Reclamation Mining&Safety AUG 2 5 2016
1313 Sherman St. Rm 215
Denver,Co 80203 DIVISION OF RECLAMATION
MINING&SAFETY
August 22, 2016
In a letter dated July 17,2016, in which I had stated opposition to the"Pueblo County aggregate Project",there
has been a collaborative movement and some issues have been resolved. Due to negotiations with the principle
participants, I can now support this project.
1)The close proximity to the Bessemer Canal.
The Bessemer Ditch Company has indicated that they would be in agreement with this project if the gravel pit
would be no closer than 1000 feet. In reality the gravel pit will not be within%mile or 1320 feet of canal.
2)The disruption to an established population.
The "farm road" is a leased right of way,or known as the 441h Lane project, through the neighborhood. The
principles have leased this right of way for a 20 year period. Mr.John P.Ary,of Freemont Paving has indicated a
southwestern route to 361h Lane would be sufficient and has agreed to abandon the farm road or 44th Lane and
simply let his 20 year lease expire. 361h Lane is the existing gravel hauling route and impacts are to a minimum.
He has also indicated his willingness to upgrade 36th Lane.
3) Rejection by Pueblo County on two prior applications.
Due to the community need and expansion of currently used gravel pit and the support of the schools, which are
in close proximity of this project, it would be incumbent for Pueblo County to realize the impact this could make
on the entire area. The existing gravel pit will be mined out of existence in approximately two years. Since the
county obtains gravel from this area, and we are looking at the widening of Highway 50, it may very well be in
everyone's interest to support this endeavor. The other suitable sites, I mentioned were a greater distance from
the city and expenses to other gravel pits would create much more travel expense to the county for gravel.
Due to collaboration and negotiation, I change my stand on this from opposition to support.
G,l-o GJA--L—
Senator Larry crowder
Senate District 35
