Specifically, this <br />letter includes revised drawings to replace the previously submitted versions of Exhibits C-1 and <br />C-2. These drawings were revised to more clearly show the existing conditions and planned <br />operations under the mining plan, but they do not alter any other aspect of the submittal or the <br />written mining plan in Exhibit D. <br />Also, as we discussed in response to your initial correspondence concerning this application, a <br />sustained and continuous effort with RTD has not yielded any new documentation regarding <br />the reclamation permit process. In sum, RTD does not object to Brannan's application as a <br />future operator but RTD does not desire to alter its contract prior to our closing date of <br />September 22, 2016, after which Brannan will own the subject property. It is my understanding <br />that Brannan's ownership of the property will be a condition prerequisite to permit issuance, <br />and we fully expect to furnish a copy of the deed to that effect by the end of September, while <br />the permit is still under review. I appreciate the Division's action to deem the application <br />complete, as we look forward to initiating published notice and reaching out to structure <br />owners and other neighbors. <br />This letter and a copy of revised Exhibits C-1 and C-2 have been placed with the Weld County <br />Clerk and Recorder. A receipt is attached.
