This document is the proposed decision of the Colorado Division of Reclamation, Mining and Safety <br />(the Division) in response to a request for a Phase I, II, and III bond release at the Southfield Mine, <br />Division file number C-1981-014. The package contains four parts. These include: 1) procedures and <br />summary of the bond release process; 2) criteria and schedule for bond release; 3) observations and <br />findings of the Division regarding compliance with the bond release requirements of the Colorado <br />Surface Coal Mining and Reclamation Act and Regulations promulgated thereunder; and 4) the <br />Division's proposed decision on the request for bond release. <br />Detailed information about the review process can be found in the Act and the Regulations of the <br />Colorado Mined Land Reclamation Board for Coal Mining. All Rules referenced within this document <br />are contained within the Regulations. Detailed information about the mining and reclamation operations <br />can be found in the permit application on file at the Division offices, located at 1313 Sherman Street, <br />Room 215, in Denver, Colorado. <br />The Southfield Mine is an underground mine, which was permitted and operated by Energy Fuels Coal, <br />Inc. (EFCI). The ownership of the land for which bond release has been requested is private, and the <br />coal ownership was private. Reclamation for which bond release has been requested was conducted in <br />2014 (replacement of Corley domestic well) and 2015 (wells, boreholes). Other reclamation activities <br />with no associated costs were performed in 2002 (MW -NW road spur) and 2012 (subsidence repairs). <br />EFCI also requested release of liability for 2,713.3 permitted and affected acres. The Division is <br />proposing to release 2,734.05 acres, because there are additional acres that could have been released with <br />SL -03. This is accounted for in the recorded permitted and affected areas in the Division Permit System. <br />With SL -04, EFCI has applied for Phase I, Phase II, and Phase III release for 3.2 acres that is associated <br />with surface disturbance. This includes release of 3.0 acres for the road to MW -65 (which has been <br />designated as a permanent road) and 0.2 acres for the spur off of the MW -NW road. There was no <br />liability for the surface disturbance associated with the wells and boreholes, only the wellbore was <br />included in the mine's liability. <br />Southfield Mine C-1981-014 Page 1 of 12 August 22, 2016 <br />SL -04 <br />
