b. If required, Lessee shall prepare and file a Storm Water Management Plan, and <br /> Lessee shall be responsible for implementing procedures and monitoring compliance with said <br /> Plan. Lessor shall provide a clean, clearly marked map of the permitted area so that Lessee may <br /> set up and commence operations in the permitted area. <br /> C. Neither Lessor nor the Lessee shall use the Leased Premises, or permit them to be <br /> used for any nuisance, or anything against public policy, or for any purpose or use in violation of <br /> the Permits or the laws or rules and regulations of any governmental body or authority applicable <br /> to the Leased Premises. <br /> d. All provisions and revisions, amendments, expansions, or modifications to the <br /> Permits shall be shared with Lessee upon execution of this document; and any subsequent <br /> revisions, amendments, expansions or modifications sought by Lessee shall first be subject to <br /> Lessor's prior written consent, which shall not be unreasonably withheld. Those provisions and <br /> revisions, amendments, expansions, or modifications to the Permits are incorporated herein and <br /> become part of this Lease. <br /> e. Lessee shall comply with all applicable federal, state and local laws, rules and <br /> regulations of governmental bodies and agencies regulating the Leased Premises and with all <br /> conditions and requirement of the Permits insofar as such conditions and requirements pertain to <br /> operations hereunder by Lessee on Lessor's Property. <br /> f. Lessee shall be responsible for stripping and reclamation activities in the areas <br /> Lessee mines and disturbs on the Premises. Lessee shall reclaim all such mined areas at least to <br /> the specifications in accordance with the reclamation plan under the Permits and to the <br /> satisfaction of the Division of Minerals and Geology. <br /> g. Lessee shall cooperate with Lessor to expeditiously complete operations and <br /> reclamation obligations to allow Lessor to construct water storage facilities as designed. Upon <br /> completion of mining and reclamation on portions of the Premises, Lessor shall have all rights to <br /> utilize such portions of the Premises. <br /> h. Lessee shall comply with all applicable federal, state, and local pollution control <br /> and environmental protection laws, regulations and rules, including but not limited to the rules <br /> set forth in Addendum 1 attached hereto. <br /> i. Lessee shall pay all costs and expenses for utilities, electricity, and fuel for <br /> Lessee's operations on the Premises. <br /> 12. Liens; Claims. If, because of any act or omission of Lessee, its agents, employees, <br /> licensees, invitees, any claim is made against Lessor's Property or Lessee's reclamation bond or <br /> if any mechanic's lien or other lien, charge or order for the payment of money shall be filed <br /> against Lessor or any portion of the Leased Premises, Lessee shall, at its own cost and expense, <br /> cause the same to be discharged of record or bonded within thirty (30) days after the filing <br /> thereof. <br /> 13. Insurance. Lessee agrees to keep in full force and effect, and pay the premiums thereon, <br /> a policy or policies of public liability and property damage insurance covering all of Lessee's <br /> ACTIVE 41 l 47961 v 1 07/06,/2016 3 <br />
