1,2 Legal Description
<br />The permit area is located in the following sections (6th Principal Meridian):
<br />• Sections 1, 2, 3, 10, 11, 12, 13, 14, 15, 22, and 23, Township 3 North, Range 94 West;
<br />• Sections 12, 13, 23, 24, 25, 26, 27, 34, 35, and 36, Township 4 North, Range 94 West;
<br />• Sections 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 14, 15, 16, 17, 18, 19, 20, 21, 22, 28, 29, and 30,
<br />Township 3 North, Range 93 West;
<br />• Sections 7, 13, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 26, 27, 28, 29, 30, 31, 32, 33, and 34,
<br />Township 4 North, Range 93 West.
<br />A more precise legal description can be found on page 2.03-14 of the Permit Application
<br />Package (PAP). The legal description has changed as noted above and on page 2.03-14 of the
<br />PAP as a result of PR -04.
<br />2. Proposed Decision
<br />The Division proposes to approve with conditions this application for revision (PR -04) of a
<br />valid, existing permit (C-1981-019) to conduct surface mining and reclamation activities in
<br />Colorado.
<br />Prior to PR -04, 17 stipulations were added to the Colowyo permit during previous approvals; 10
<br />of the 17 have been complied with and terminated. With PR -04, five additional stipulations were
<br />added: Stipulations 18, 19, 20, 21, and 22 (described below).
<br />The following stipulations remain a binding part of the Colowyo Permit.
<br />STIPULATION 2:
<br />PRIOR TO DISTURBING ANY LANDS IN THE LOWER WILSON AREA, THE
<br />COLOWYO COAL COMPANY SHALL PROVIDE THE DIVISION WITH A PERMIT
<br />REVISION CONTAINING A MINE PLAN AND A RECLAMATION PLAN AND ANY
<br />ADDITIONAL BASELINE MONITORING INFORMATION (SURFACE WATER, GROUND
<br />WATER, SOILS, VEGETATION, ETC.) REQUESTED BY THE DIVISION. THE
<br />APPROVAL OF PERMIT REVISION 02 IS ONLY AN APPROVAL FOR DISTURBANCE
<br />IN THE SOUTH TAYLOR PIT (SOUTH TAYLOR PIT, WEST VALLEY FILL, EAST
<br />VALLEY FILL AND ASSOCIATED STRUCTURES). NO DISTURBANCE IS APPROVED
<br />FOR THE LOWER WILSON AREA WITH THE APPROVAL OF PERMIT REVISION 02.
