XV. Air Resource Protection - Rule 4.17 <br />The Permit was found to comply with Rule 4.17. The mine operates under a valid air resource <br />protection permit issued by the CDPHE. <br />A description of the air pollution control plan is found in Section 2.05.6. Air Quality permits <br />issued by the CDPHE-Air Pollution Control Division are identified in Section 2.03.10, and <br />copies of the permits are located in Exhibit 8. CCC maintains two facility -wide Air Permits, No. <br />95MF 1040 and No. 06RB 1317, with CDPHE-Air Pollution Control Division. <br />CCC will need to obtain an approved CDPHE Air Permit for the Collom permit expansion area <br />prior to disturbing lands within the Collom permit expansion area. CCC is conducting air <br />modeling and preparing an application for this permit. <br />XVI. Protection of Fish, Wildlife and Related Environmental Factors - Rule 4.18 <br />The Permit was found to comply with Rule 2.05.6(2)(a) and Rule 4.18. <br />Descriptions of fish and wildlife resources are contained in Sections 2.04. 11 of the PAP. A fish <br />and wildlife mitigation plan is found in Section 2.05.6(2) of Volume 15. Other wildlife -related <br />information is contained in Section 4.18; Exhibit 11; and Maps 13, 14 and 15 of the PAP. <br />A. Deer and Elk <br />Colowyo has worked closely with CPW in developing its wildlife and range condition <br />inventories and its deer and elk habitat mitigation plan. The entire permit area is designated as <br />winter range for both mule deer and elk. <br />Colowyo has proposed additional measures to re-establish sagebrush -steppe communities, <br />providing benefit to mule deer, elk, sage grouse, sharp -tailed grouse and other species. During <br />the review of PR -03, Colowyo worked in cooperation with CPW to accommodate CPW's <br />wildlife impact concerns. Colowyo agreed to incorporate CPW's recommendations outlined in <br />CPW's letter to Colowyo, dated May 17, 2011. <br />B. Sage Grouse <br />CCC has proposed to mitigate impacts to GRSG and other species with the following <br />commitments: <br />• Eliminate direct disturbance of active leks and avoid indirect disturbance with mitigation <br />measures <br />PR -04, Colowyo Coal Mine C1981-019 60 August 2016 <br />
