D. Specific Findings Required by Rule 4.06
1. The Division approved alternative procedures for topsoil protection following removal based
on a demonstration that such alternative procedures provided more protection for the topsoil.
2. The Division approved a waiver of the requirement for clearing of vegetation cover prior to
topsoil removal. CCC has demonstrated that inclusion of vegetation cover in salvaged topsoil
is necessary or desirable to ensure soil productivity consistent with the postmining land use
[Rule 4.06.2(1)].
The Division granted a variance from topsoil removal in accordance with Rule 4.06.2(2)(a).
Areas which may qualify for variance are: areas where light traffic does not destroy existing
vegetation, areas where removal would result in needless damage to soil characteristics, steep
slopes of minimum topsoil depths, on steep slopes hazardous for equipment operations, and areas
of construction of small structures such as power poles, signs or fence lines.
V. Sealing of Drilled Holes and Underground Openings - Rule 4.07
The Permit is found to be in compliance with Rule 4.07. Each exploration hole, borehole or other
exposed opening constructed or encountered during mining will be cased, sealed or otherwise
managed (some holes are mined through) according to the requirements of Rule 4.07. Details are
found In Volume 1, Section 2.05.4 of the PAP. Monitoring wells will be fitted with temporary
caps or piezometers. Holes dug to aquifers will be sealed with cement or other suitable sealant to
within three feet of the surface.
Vl. Use of Explosives - Rule 4.08
The Permit is found to be in compliance with the requirements of Rule 4.08. The blasting plan is
found in Section 2.05 and in Section 4.08 of the PAP. The Permit provides typical blasting
patterns, and blasting patterns specific to each blast are recorded on the individual blasting
records (Rule 4.08.5).
Map 26B shows the distance to the closest residence to the proposed Collom Pit, which is greater
than 9,000 feet from the closest portion of the pit. This residence, owned by Canon Family
Partnership, is located in T3N, R93W Section 7.
In accordance with Rule 4.08.2(1), Colowyo will offer pre -blast surveys to owners of all
structures located within one-half mile of the permit area. In addition to buildings, ditches,
ponds, out buildings, and roads, structures also include power pole foundations, groundwater
supply wells, and pipelines.
PR -04, Colowyo Coal Mine C1981-019 47 August 2016
