Box 2 <br />Colorado Springs, CO 80901 <br />RE: Need for State Reclamation Permit, April Fool's Lode, File No. M-2016-011 <br />Dear Mr. Yamiolkoski: <br />In a correspondence dated February 23, 2016, the Division of Reclamation, Mining and Safety <br />(Division) informed you of your obligation to obtain a reclamation permit prior to engaging in a <br />mining activity. On June 28, 2016, the Division received your correspondence, responding to <br />the Division's inquiry, RE: "Is It Mining". <br />The information you provided indicates members of the Colorado Springs Mineralogical Society <br />will dig for mineral specimens on USFS lands, specifically within the boundaries of the April <br />Fool's Lode, an area of approximately 20.66 acres. The excavation activity will be conducted <br />with hand tools. Mineral specimens will be removed from site. The Colorado Springs <br />Mineralogical Society has submitted a Notice of Intent for Mining Activities with the USFS. <br />The Colorado Mined Land Reclamation Board (Board) has requested the Division make <br />preliminary determinations regarding the need for a mined land reclamation permit. Based on <br />the information provided in your response, it is the Division's opinion the proposed project is a <br />mining operation. Pursuant to Colorado law, you are required to first obtain a mined land <br />reclamation permit from the Board prior to initiating the mining operation. If you disagree with <br />the Division's determination you may petition the Board for a declaratory order whereby you <br />may obtain an exemption from permit requirements. Such request must be made in writing <br />and must be received no later than ten days prior to a regularly scheduled Board meeting.
